"We are saddened that his family is going through such a situation," says Sheriff Ken Irwin. "We'll leave it at that." KIMA Action News uncovered shocking details in the police report. It all happened last weekend at a house in Selah. Out of respect for the victim, we will only say she is a person the deputy knows well. And that woman claims Deputy Moore held a gun to her head, punched her in the face, and sexually assaulted her. If that wasn't bad enough, she says he was wearing his uniform, and was on duty. In Selah, none of Deputy Moore's neighbors wanted to talk to Action News on camera, but they all told KIMA the same thing: that Deputy Moore was always friendly and outgoing. They say he never seemed capable of committing the crimes he's accused of doing... He's now on leave from the Sheriff's Office while Selah police continue their investigation. The Sheriff's Office wouldn't say if it's had previous issues with Deputy Moore. DEPUTY FACING MULTIPLE CHARGES AFTER REPORTED SEXUAL ASSAULT

[Excerpts] Bail of $500,000 was set Thursday for a Yakima County sheriff's deputy arrested Wednesday night after a woman reported he entered her home and sexually assaulted her while on duty. Deputy Sean Moore, 37, made a preliminary appearance Thursday in Superior Court, where he could face charges of first-degree assault, second-degree rape and first-degree burglary. In seeking the high bail, deputy prosecutor Susan Arb said Moore had apparently been trying to identify the woman's male friend who had been at the house. "The state is quite concerned for the safety of both victims," Arb said, describing the woman in particular as "truly frightened." The Sheriff's Office has started a separate internal investigation to determine whether Moore violated any department policies... Moore, a seven-year deputy who was working and in uniform at the time of the incident, and the woman were well known to one another, according to the Selah police report filed in court to support the arrest... According to the report, the woman told police that he entered her Selah home early Sunday while she and a friend were sleeping. The report said Moore pointed his duty pistol at her and asked the friend, "How would you like to see her die?" She said Moore demanded the friend leave as he repeatedly punched her in the back of the head, according to the report. Moore then got into his patrol car and told the other man, who had been walking to his truck, that he'd arrest him if he didn't accept a ride, the report said. The man refused and, according to the report, Moore drove away when the man said he would report the incident to the Sheriff's Office. The patrol car's GPS locator system shows that it was parked near the home when the woman said the incident took place, according to police. The friend stayed the night at the house because the woman said she feared for her life, the report said. The woman said Moore returned later in the morning after the friend had left. She said he again pointed the gun at her head and asked if she wanted to die, according to the report. She reported she was kicked, hit and choked before engaging in sex out of fear for her life, the report said. The report also said she told police there'd been numerous previous incidents of domestic violence... Selah police Chief Stacy Dwarshius said Selah police started hearing rumors of the Sunday incident on Monday from friends of the victims who were concerned that it had not been reported. Officers started trying to find the woman to make sure she was all right. The friend was the first to be located, on Tuesday evening, and the woman came to the police station Wednesday to give a statement, Dwarshius said. Moore turned himself in at the police station on Wednesday evening and was booked into jail... Moore is a member of the department's SWAT team... County Prosecuting Attorney Jim Hagarty said his office was arranging to transfer the case to prosecutors in another county to eliminate any potential for a conflict of interest. PROSECUTOR SEEKS HELP WITH OFFICER CASES

[Excerpts] Yakima County Prosecuting Attorney Jim Hagarty said Friday he'll seek another prosecutor to review allegations against a Yakima police officer accused of groping a woman after barging into her home earlier this year. Meanwhile, he was also waiting on a request for another agency to handle pending charges against a Yakima County sheriff's deputy jailed after reports that he beat and sexually assaulted a woman. The state Attorney General's Office could agree to take both cases, or Hagarty might have to find a special prosecutor, perhaps from another county... He said that, in hindsight, it might have been best to transfer the case at the start... In the latest case involving a law officer, Hagarty has already said that he would look for another agency to handle the case of sheriff's Deputy Sean Moore. Moore was jailed Wednesday after Selah police investigated reports that he had entered a Selah home and assaulted a woman and a male friend while on duty and in uniform. The woman and Moore know one another. Moore remained in custody Friday on $500,000 bail on suspicion of rape, assault and burglary. He must be charged by Monday or be released. Hagarty said his office would make a preliminary charging decision if a special prosecutor had not been secured by then. Selah police said they were continuing to gather information in their case against Moore. Chief Stacy Dwarshius said officers believe they have seized all of Moore's known weapons, including six handguns, a department-issued rifle and shotgun and several other rifles and shotguns. Court records reviewed Friday showed that the woman Moore is accused of attacking obtained a temporary protection order against him in 1995. The woman alleged that Moore kicked her car when she tried to leave and had repeatedly assaulted her, among other incidents. A Yakima County court commissioner dropped the case when the woman did not show up for a hearing to request a permanent protection order. The woman this week told Selah police that Moore's behavior had become increasingly aggressive after he was involved in an on-duty shooting of a suspect in 2004. Sheriff Ken Irwin said the protection order should have surfaced during Moore's background investigation before he was hired in 2003. Deputy Sean Moore, 37, is scheduled for arraignment in Yakima County Superior Court next week... The charges include first-degree assault, first-degree burglary, first-degree rape, all with a domestic violence enhancement, and a fourth charge of second-degree assault. The charges are based on events at the woman's Selah home Oct. 24. Moore, a deputy sheriff for seven years, and the woman knew each other for years, according to a probable cause affidavit filed in court... The Yakima Valley right now is seeing two cases of serious allegations of crime by those committed to stopping crime, one involving a Yakima police officer and another a Yakima County sheriff's deputy. This is always a sensitive and difficult issue, but the public's trust in the criminal-justice system - from the police department to the county prosecutor to the courts - hinges on the cases being treated with transparency and fairness. Critics say that hasn't happened in the case of a Yakima police officer who is accused of barging into a woman's home and then groping her... The woman's lawyer, Bill Pickett, claims Hagarty was delaying because he wanted to curry favor with police officers in an election year, a claim Hagarty firmly rejects. But Hagarty could have deflected such allegations by moving more quickly on the case. Hagarty's approach seems to be an extension of his policy of personally handling cases involving attacks on officers. That's well and good, to show to officers that the prosecutor has their back, but pretty much everyone in law enforcement knows everyone else in Yakima County. Moving against somebody you know puts everyone in a difficult situation. In a second case, Hagarty from the start began looking for another agency to handle it. DEPUTY JAILED ON RAPE CHARGE WILL ASK FOR LOWER BAIL

[Excerpts] An attorney for Yakima County sheriff's Deputy Sean Moore says his client will plead innocent today to charges that he raped a woman while on duty. Moore, 37, is scheduled to be arraigned in Yakima County Superior Court in connection with an Oct. 24 incident in which he is accused of breaking into a Selah home and forcing the woman to perform a sex act. He's also accused of assaulting the woman and threatening her male friend at gunpoint earlier the same day at the house. Moore was on duty and in uniform when the first contact happened, according to the police report. Bellingham attorney Jeffrey Lustick, who represents Moore, said the seven-year deputy is prepared to take the case to trial... Lustick said he would ask for Moore's bail to be reduced, calling the amount excessive under the circumstances... Lustick said he would also ask that Yakima County prosecutors be ordered to recuse themselves... Sheriff Ken Irwin said a separate personnel investigation into the allegations against Moore is expected to continue for some time... [Excerpts] A judge declined Friday to reduce bail for a Yakima County sheriff's deputy accused of raping a woman while on duty. Deputy Sean Moore's attorney argued that bail of $500,000 is excessive and effectively restricts Moore to solitary confinement in jail. The prosecutor objected, citing the serious nature of the charges. Evidence indicates Moore was trying to target the woman's male friend and the woman believes Moore would try to kill her if he's released, County Prosecutor Jim Hagarty said. Judge Don Engel, a District Court judge handling felony arraignments for the day, agreed to maintain the bail. Engel said he was concerned that evidence, including text messages, suggests Moore was trying to control the woman. During the same hearing, Moore entered innocent pleas to the rape, assault and burglary charges against him in connection with the Oct. 24 incident at the woman's Selah home.... [Excerpts] Prosecutors say Yakima County Sheriff's Deputy Sean Moore didn't even bother to change out of his uniform when he broke into a Selah home and raped a female acquaintance. Moore's lawyer says otherwise. But a history of domestic violence seems to suggest the deputy was very much capable of the crime. The 37-year-old deputy is accused of breaking into the woman's house on Oct. 24 and, in front of her friend, pulling out a gun and asking her "do you want to die?" After making the woman's friend leave, the alleged victim says Moore punched, kicked and choked her repeatedly. Then, she says, he raped her. Afterward, he apparently threatened her friend again outside the house. Then, the next day, he came back and pulled his gun on the woman yet again, positing the same query: "do you want to die?" YAKIMA SHERIFF'S DEPUTY CHARGED WITH RAPE

[Excerpts] A Yakima County sheriff's deputy accused of breaking into a home and forcing a woman to perform a sex act has pleaded not guilty... [His lawyer Jeffrey] Lustick earlier told The Associated Press his client has a long history of public service and poses no danger to the community. "We have a defense to every one of these charges," the lawyer said. "We will prove his innocence at trial." Lustick declined to discuss what those defenses are pending the appointment of a special prosecutor in the case... Moore is being held in the Kittitas County Jail in Ellensburg. COMMENT BY Just_Bob: According to Yakima coverage, the earlier alleged incident occurred during the middle of the night while he was on duty and in uniform. He allegedly broke in and rousted them from bed at gun point and ordered the guy to leave. I'm thinking "poses no danger to the community." is some kind of lawyer gibberish.

  3. This is the same deputy that harassed my son after sleeping with my sons ex girl friend, he would see him driving on the road and pull him over for no apparent reason and tell him he was watching for him. All because my son put a harassement charge against his ex- girl friend

    [Excerpts] A Yakima County sheriff's sergeant [George Town] could be disciplined for allegedly refusing to help a Selah police officer [Rich Brumley] who was involved in the rape arrest of Deputy Sean Moore ... [Selah police Chief Stacy] Dwarshuis complained that Town had refused to assist Selah police Officer on a minor theft case. Brumley was part of the arrest last month of Deputy Sean Moore, a friend and colleague of Town's. "One can surmise that Sergeant Town's actions are a direct result of his belief that this department is maliciously persecuting a fellow law enforcement officer," wrote Dwarshuis ... The memo is just the latest evidence of tension within the local law enforcement community since Moore's arrest last month. Some officers have complained the deputy received special visitation privileges at the county jail shortly after his arrest ... Acting on records requests from the Herald-Republic, Selah city officials released several documents Monday that describe Brumley's request for assistance and Town's explanation that no one was available. They also released a transcript of related dispatch tapes. According to reports, Brumley had seized several possibly stolen credit cards as part of a traffic stop the night of Nov. 10 and requested that a deputy contact the card's owner in Tieton.     ...As for complaints about Moore receiving special visitation privileges at the county jail, Irwin said he was aware of the complaints but felt that Corrections Director Ed Campbell had taken steps to address them. Irwin said he was allowed to meet with Moore shortly after his arrest as a "professional courtesy." As fellow deputies began to line up to visit Moore, Campbell stepped in and made sure Moore did not receive more visitors than normally permitted, Irwin said. "That (too many visits) was starting to be set up, but Chief Campbell saw it and rightly put his foot down"... The sheriff said he has since put out a memo to his deputies warning them not to use the Sheriff's Office letterhead in character letters to the court or to attend court sessions on Moore's behalf while in uniform... Campbell, a former sheriff's deputy who was a top aide to Irwin before taking over at the Department of Corrections last year, said the normally friendly relationship between jail staff and law enforcement has put a strain on his staff...   9. The shameful aspects of police culture have to change. An officer should be allowed to do his professional job without having to be subjected to a-holes that think the department is a club. It's not. Blessings to Officer Brumley and all those like him who are just doing their jobs and end up needing a heroes recognition for having done so. It shouldn't be that way.

  11. To the Mother whose son was harassed by Deputy Moore...Please contact Officer Brumley> i know him and I promise you can trust him. The reason this Deputy was allowed to believe he was above the law is because not enough people that he treated poorly or in some cases commited crimes againt did not come forward. Sheriff Irwin is ultimately resposible for his behavior. There have been hundreds of warning signs over the years Deputy Moore has been at YSO, the signs were ignored or brushed under the rug by the good old boys at YSO...It has been going on since Irwin took over the agency....Promote the problem has always been the norm at the agency...Sergeants that do not control their Deputies and no accountability...There is not an Officer in Yakima County from any agency that does not believe that at least some of the allegations against Deputy Moore are true...I for one believe it all

  13. I promise that Officer Brumley and the Selah Police are some of the best and most ethical Officers in Yakima County if not the State. They will do everything within their power to protect the victims and witnesses in this case. Jim Hagarty and everyone at the Yakima County Prosecutors office will also do everything they can. Please come forward if you have information. If a point comes when they have to disclose your information they would not do so without your permission, if you want to remain anonymous the will respect your wishes.

  15. I lived next to Officer Moore for several years, and called upon him for assistance twice. He was a good neighbor, and a friend. Officer Moore was professional and extremely helpful. He was understanding and helpful, as well as representing the YCSO in a positive light. I for one feel that he is innocent until proven guily beyond a reasonable doubt.

  17. thank you for the response as i under stand it you have already contacted my son last week and he came down and gave a statement although i am not sure how you knew it was him, I am still glad he came forward and gave this statement becuase i was very upset know a law inforcement agent was harressing my child for no reason other then a vendetta

  19. As per the article in paper yesterday. Sheriff Irwin seems to be all over the place with his statements define brief relationship over a year, define no problems in his past a prior no contact order and several trips by law enforcment to his home in the last year.I guess this is going to be a protect your good ol boys at any cost even a life. Is it really safe for department personal to be in relationships. I guess this is just another thing Irwin was not aware of.

  20. Sean didnt know much about the harrasment charges or the conflict between me and your son. He was probably being a good officer considering your sons 2 DUI charges in that short amount of time. After he was just in a car accident with his ex girlfriends boss and he passed away drinking and driving with your son. He also knew about your daughter threateing my life saying they were gunna slit my throat. He also knew about your son sending love letters asking to have a baby with him. Harrassing me at my work and getting kicked out of the store. He told your sons ex girlfriend leave the drama behind. He also gave your son advice on his first DUI. All this happened way back in March he pulled him over in October. Personaly I have never seen Sean voilent I was his neighbor to for a while also he was very kind and helpful. He was a good friend to me. I think its mesed up when someone gets in trouble everyone comes out of the woodworks and wants everyone to feel sorry for them. When he was a good police officer. He was doing his job when he knew he was driving without a licence its sad it was him that had to pull him over and get blamed for doing his JOB.

  22. I agree that the Selah police department is a great department. No doubt about that. I also feel that the Sheriff's office is a great agency. Don't blame the entire agency for the actions of one officer. The deputies at YSO are professional and ethical officers. Sean Moore will get his day in court. I feel for the victim and hope all works out well for her. No matter the outcome of the trial Sean's professional life in law enforcement is over. It will be difficult for him to account for the time he was in jail.

  23. There's supposed to be a call to the police on domestic violence. Dwarshuis should go by the law like anybody else. This whole thing was to try to get Rosenow in as sheriff, which would have been a disaster. The victim was 30 when she got her hands on a 17 year old child. He was robbed of his entire boyhood.

    Re: In Custody Death

    On 5-21-11 at approximately 2130 hours inmate Sean Moore was found by Yakima County Corrections Officers unresponsive in his cell. Officers performed CPR until medical staff arrived and took over. Moore was transported to Yakima Regional Hospital by ambulance where he was pronounced deceased shortly after arrival.

    Moore was housed on the third floor of the Main Jail in a medical unit due to an ongoing medical condition. He was placed into protective custody related to his affiliation with law enforcement and charges. The unit where Moore was housed requires cell checks be done on ½ hour intervals. Officers last conducted a routine cell check of Moore’s housing at approximately 2105.

    Moore entered into custody on October 27th 2010. He was housed in both the Yakima County jail and Kittitas County jail during that time, except during short periods where he was hospitalized for medical issues.

    The Yakima County Sheriff’s Office is investigating. An autopsy will be scheduled to determine the cause of death.

    The Yakima County Department of Corrections is conducting an independent internal investigation.
