[IL] Officer Sain's estranged wife didn't answer her door, so he broke in and injured her (police chief) company

[Excerpts] North Chicago police officer Carl Sain admitted he broke into his estranged wife’s house and searched it at gunpoint, but denied attacking Waukegan Police Chief Artis Yancey after finding him inside the home. Sain today told a Lake County jury that Yancey started the June 17, 2009 altercation that resulted in Sain being charged with felony aggravated battery. “He threw the first punch,” Sain said, testifying in his own defense. Sain, though, acknowledged he searched the Waukegan house he once shared with his wife until he found Yancey in the master bedroom. Though stunned and angry, Sain repeatedly insisted he didn't attack Yancey — whom he knew casually... The confrontation occurred several months after Sain and his wife had separated. But Sain said he still had hopes of reconciling with his spouse, though she had filed for divorce. The 46-year-old Sain — who just months earlier had been named North Chicago’s “Officer of the Year” by a civic group — faces up to five years in prison if convicted. He is accused of pummeling Yancey so badly that he broke several bones in the chief's face, requiring him to undergo surgery to repair the damage... Yancey, 50, testified earlier this week that an enraged Sain had stuck a gun in his face, then wrestled him to the ground and punched him repeatedly in the face with his fists and the handgun... He rang the doorbell and knocked for several minutes, then when there was no answer he used his handgun to smash a window panel, then reached in and unlocked the door. As he entered the home, his wife came down the stairs — and ordered him to leave, Sain said. “She told me to get the f--- out of her house,” Sain said. [Excerpts] ...We're told when [North Chicago Police Officer Carl Sain] went upstairs he found Waukegan's top cop - Artis Yancey - there. According to the state's attorney, Sain knocked Yancey down and punched him out. Sain's wife called 911. When responding officers got there, they found Sain's bloody service revolver. The state's attorney says it's not clear if Sain used it to pistol-whip Yancey, because his own hand was bleeding from breaking the window to get in. Yancy has fractured bones in his face and needs surgery... Sain declined comment when asked if he had anything to say... But Sain did thank people who have shown him support... "He's a fine officer," Mayor Rockingham said of the 15-year veteran. Sain wouldn't say anything about his relationship with his wife. [Excerpts] The North Chicago police officer accused of beating up Waukegan Police Chief Artis Yancey was indicted on those charges this week. A Lake County grand jury indicted Carl Sain on three counts of aggravated battery and one count of aggravated assault... Sain allegedly attacked Yancey, and struck him with his fists and his handgun... Sain has been placed on administrative leave by the North Chicago Police Department. He is due in court for an arraignment hearing July 23 before Circuit Judge Fred Foreman. [Full article here]

[Excerpts] A North Chicago police officer charged with attacking Waukegan Police Chief Artis Yancey pleaded not guilty Thursday in Lake County Circuit Court. Carl Sain, 45, faces up to five years in prison if convicted of aggravated battery, but would also be eligible for probation. Assistant State's Attorney Reginald Matthews said Sain went to visit his estranged wife at her Waukegan residence June 17. Sain rang the doorbell several times, then kicked in the door when he was not admitted, Matthews said. Yancey, who was appointed chief in Waukegan in March, was inside the residence at the time, and police said he was attacked by Sain. Yancey suffered several bone fractures in his face and had surgery to repair the damage. Circuit Judge Fred Foreman told Sain he was to have no contact with his wife except through their respective divorce attorneys. Sain, who was placed on administrative leave immediately following his arrest, is due back in court Aug. 14. [LINK
