A Weaverville police sergeant has resigned after Madison County deputies charged him with simple assault early Tuesday.

Andy Cody, 38, of 138 Brook St., Mars Hill, was taken into custody after deputies responded to reports of a disturbance at his home about 4 a.m., officials said

“There were obvious signs of domestic violence” involving Cody and a female at the residence, Madison Sheriff's Capt. Buddy Harwood said. Cody was released on a promise to appear, the arrest report notes.

Later in the day, Cody sought a domestic violence order of protection against Angela Tweed, 38, whose relationship with Cody was described on court documents as “unmarried, of opposite sex, currently or formerly living together.”

According to the order, which was issued by a Madison magistrate, Cody swore that Tweed “hit (him) on and about the head and face and made threats.”

Weaverville Police Chief Gregory Stephens said Cody resigned Tuesday. He said Cody had "done a great job" as a shift supervisor at the department. He worked as a Weaverville police officer since 2002, Stephens said. [LINK]

Doesn't take long to put a police officer on a site about domestic violence, even before he is proven guilty or not....if people would read the article it says that HE GOT A PROCTIVE ORDER AGAINST HER. What happened to innocent until proven guilty....I guess that doesn't go for everyone...but it should.....Rest In Peace Andy and be an angel over all the Police Officers that are out there doing a great job just like you did.
