[TX] Who chopped off the fingernails of Sgt. Fennell's slain fiance'?

When Giddings Police Officer Jimmy Fennell's fiance Stacy Stites was found strangled on the side of a dirt road, her fingernails were cut to the quick, roughly and not filed - eliminating any evidence that might have been recovered from beneath them.
He failed two lie detector tests when asked if he killed Stacy. Fennell, now a Georgetown Police Sgt. was arrested this past week for the October rape at gunpoint of a domestic violence victim - whose account matches her fingerprints on the back of his patrol car.


Stacy's body was unaccounted for for over an hour after being removed from the scene, arriving at the morgue with new injuries - including burns - that were not in photographs taken before she was transported. DNA from 2 cops were found on the beer cans at the site. Witnesses for convicted & sitting on death row Rodney Reed were never called to testify and the judge who denied the appeal when even more evidence came to light is the daughter of the judge who convicted Reed.

Jimmy Fennell, Jr. Is charged with sexually assaulting a woman at gunpoint last October. Some say the cop's arrest could help set another man free from death row. [Excerpts] There are renewed calls to grant a Texas death row inmate a new trial in connection with the murder of Stacy Stites in Bastrop 11 years ago. This comes after a former suspect in her murder - her fiancé, who is a police officer - was charged with three felonies on unrelated charges Tuesday... Rodney Reed has been on death row since 1998 after he was convicted of the crime. His family believes in his innocence and says Fennell's indictment this week will help their case. "They didn't find him guilty. They said he was guilty. That's two different things," Rodney's father Walter Reed said... New evidence in Reed's case surfaced last year when a witness testified she saw [Georgetown Police Sgt. Jimmy] Fennell and Stites together the morning before her death. Martha Barnett's testimony contradicted some of the information attorneys were working with when Reed was convicted in 1998. But a Bastrop County judge said that evidence wasn't enough to warrant a new trial. Harrington pointed out Wednesday that Fennell's testimony played a role in Reed's conviction. And in light of Fennell's indictments, Reed should be given a new trial... Reed will plead his case before the Court of Criminal Appeals in the next few weeks...

[Excerpts] When 19-year-old Stacy Stites was found murdered on April 23, 1996, the small central Texas town of Bastrop was shaken to its core. Now, almost a decade later, Bastrop is shaken again by evidence suggesting that the person convicted of her murder, Rodney Reed, is an innocent man railroaded to death row... One witness told the hearing that Jimmy Fennell, Stites' fiancé and a local police officer, was seen arguing with Stites in the early-morning hours before she was found dead. Another testified that, while attending a police training session with Fennell, she heard him say that if he found out his girlfriend was cheating on him, he would strangle her with a belt, so as not to leave fingerprints - exactly how Stites was murdered... Photos taken at the medical examiner's office show burns and injuries that weren't in images from the crime scene itself... A May 13, 1998, Department of Public Service report states that fresh beer cans found at the crime scene contained DNA from Stacy Stites and police officers David Hall and Ed Salmela (the original investigator for the case)... The truck apparently used to transport Stites' body, which contained fingerprints from only Jimmy Fennell and Stacy Stites, was handed over to Fennell the day that it was discovered. Fennell sold the truck the next day... In a polygraph test, Fennell failed the question: "Did you strangle Stacy Stites?" Though these issues came out in the hearing, Rodney's supporters were unhappy with the proceedings. They say that Judge Reva Townslee-Corbett, whose father presided at Rodney's original trial, clearly favored the prosecution during the hearing and treated the defense team with distain... "She's guarding her father's reputation"...

[Excerpts] ...It was [Travis County Medical Examiner Dr. Roberto] Bayardo's testimony that established for the court the horror of Stites' death. Bayardo told the jury that Stites had been murdered by strangulation with her braided leather belt, and that she was raped vaginally and anally... [Nueces County Medical Examiner Dr. Lloyd] White said, he was disturbed by the condition in which Stites' body arrived at the medical examiner's office. Members of the DPS crime scene unit undressed Stites' body while she lay on a gurney on the side of the road where her body was discovered. "That's just not a proper environment for that," he said. If they are undressing her, and doing other things, he said, there is no way to ensure the integrity of the evidence, which is why it is best if a body is brought in to the medical examiner's office still clothed. "That's the standard," he said. "The reason is for the preservation of trace evidence [that would help determine cause of death]." In Stites' case, there is also no confirmed record of the custody and transport of the body from the crime scene to the morgue. According to police reports, Stites' body was removed from the crime scene no later than 8:55pm on April 23, 1996. Yet, according to Travis County Medical Examiner's records, the body was not checked into the Austin office until 11pm that night -- at least two hours later. Normally that trip would take no longer than 45 minutes. The lapse in time wouldn't be so significant, except that photos of the body taken at the crime scene do not coincide with photos taken at the ME's office the next day. Specifically, the photos show what appear to be numerous wounds on Stites' forehead, shoulders, and chest -- wounds not present in the crime scene photos, wounds that suggest that the body may have been, at least, mishandled during transport... On the body were a number of what Bayardo called "burns" -- five in all -- some of which in his autopsy Bayardo considered "near third-degree" and White says are extremely odd... White said he believes the burns are post-mortem... When Stites was found, her fingernails were cut to the quick, roughly and not filed. Indeed, Bayardo told investigators on April 24 that the nails were cut too closely to allow the removal of any trace evidence -- evidence that might have revealed or confirmed the identity of Stites' attacker.... Famed former FBI profiler Clinton Van Zandt said it's the kind of evidence that could be a valuable clue. "It doesn't jibe for [Reed] to do that," he said. "If you try to remove [evidence] from one place and not the other. That's exactly the issue." But according to the court record, it was one more issue Reed's attorneys never raised.

[Excerpts] ...Six years after Stites' death, the question remains open: Who killed Stacey Stites?... Fennell was interviewed once on April 23, by then-Bastrop Police Chief Ronnie Duncan; once by Wardlow on April 25; and on April 29, Fennell stopped by the Sheriff's Office to tell investigators about some items he felt were out of place in his truck. On that same day, six days after the murder, the pickup truck Stacey had presumably driven was returned to the man Wardlow referred to as his "prime suspect." As a result, defense attorneys were never afforded the opportunity to confirm any DPS test results, nor were they able to conduct any of their own forensic investigation on the truck. Investigators met again with Fennell on Oct. 3, to administer a polygraph exam, which Wardlow reported "indicated [Fennell] was deceptive on relevant questions." Finally, on Dec. 18, investigators met with Fennell for the last time, to administer another polygraph exam, with similar results: Fennell's test "reported a deceptive finding ... relating to relevant questions" -- specifically, whether or not he had strangled Stacey Stites... "It was clear he'd failed the polygraph -- not once, but twice," [Austin attorney Jimmy] Brown said. "My question to the state was, how is that? Why do you not consider him a suspect? There was no answer"... Investigators never even requested a search warrant for the apartment Fennell and Stites shared... DPS had not even completed all the forensic testing on the pickup truck before releasing it to Fennell...

    My son can't get a job w/ a felony misdemeanor and yet Jimmy Fennell got away w/ murder, got a job w/ the Georgetown police department and is being charged w/ sexual assault,that's funny, it's called rape when a citizen is charged....

    1. I have read every bit of information on this case after I was researching another body just found down the road from my home here in Bastrop on Hwy. 95. Well, to me it is obvious that Jimmy Fennell is most likely still the prime suspect in the murder of his then fiance Stacy Stites. As a Caucasian Bastrop Business Owner for 13 years, and father of 6 daughters, two of them who have actually worked at the same HEB grocery store as Stacy, I am appalled that the police dept. did such a horrible crime scene investigation, which was tainted by Jimmy Fennell, who presumably:
      - strangled his fiance with her own chain at night or early in morning then dumped her body on a dirt road off 1441 in Bastrop, and left his truck at Bastrop High School,
      - went back to murder scene that morning while his fiance was undressed tampering the crime scene evidence, and drank a beer with another police officer on duty. Then they cut off the victim's finger nails to hide Jimmy Fennell's DNA evidence,
      - met with the Ambulance Driver of his dead fiance, to do more damage to his dead fiance's body (burn marks and bruises) after it had been photographed at the murder scene showing that it was done post-pardon (while body was deceased). Evidence not only shows that these burn and bruise marks were not on the deceased body at the crime scene, but also that the ambulance ride took about 3 hours instead of 45 minutes, more time to tamper with the body to rid Jimmy Fennell of evidence upon him.
      - After this murder, Jimmy Fennell was found GUILTY of raping a woman and was sentenced to 10 years in prison. Jimmy Fennell is a DANGEROUS RAPIST and MURDERER.

      After researching this, I know that Rodney Reed must be let go and his name be restored.

  2. Reed only paid child support for 5 months and only after being dragged to court to do so. He never sent them birthday or Christmas presents. From 1991 to the time of his arrest in 1996, he only bothered to see them 3 times.

    Worse of all, he beat, raped and forcefully sodomized their mother repeatedly and even did so in their presence and while they were in the same bed.

    But, hey, he's got pictures of them so he must be father of the year and not a serial rapist, crack dealer, and murderer.

  3. how selfish of everyone to sit here and talk about there own problems in life. its my life we are talking about I was not just rapped that day my life was taken from me... everyone sits here talking about rodney and there problems and what he did before me no one understands what it is like to sit awake at night scared to death he might get out and look for you. everytime a dog parks outside your heart skips a beat. calling the prison to make sure he is still there so you can go to sleep. everyday is a nightmare for me cause of what he did but no one seems to remember me or look at that. If he did kill stacey imagine what he will do to me when he gets out and finds me....I would rather not be here than be so scared to live my life and have to live it scared everyday.......

  4. Are you diagnosed with PTSD because I'm sure that you have it. Most who live in daily fear do. Knowing how much serious evil has happened it would be good to consider the huge incovenience of moving away from that state completely. How far away you are does make a difference. I am so sorry that you are having to continue living with this.

DNA at the crime scene,nails clipped,finger prints one the truck, he sold the truck the next day,2 people can verify death threats,jealousy,co workers verify that she would hide when he came into HEB,.... This is just a 2015 lynching of a black man and the murder of a white woman and we all know the reason why....

      Most of your comment makes no sense but I will give it a try: Stites was a nail biter and her nails were bitten - not clipped. The truck was not sold the next day. The truck was seized and held for 7 days and processed for evidence. After it was released, Fennell's father picked it up and drove it to a dealership and it was traded it for a another truck. From all accounts Stites was very excited about getting married. Wits who wait 20 yrs to come forward are not credible. Last but not least, the dna evidence at the crime scene supports the jury verdict that Reed strangled Stites during or immediately after he raped her. You and others would know all this if you actually read the evidence instead of parroting the losers who will lie for Reed, a serial rapist and murderer.

    2. Don't know where the heck you get your info, but here nails were clipped, the truck was returned to Fennell within 24 hours, and it was immediately sold at an out of town dealership. I have no doubt Rodney is no angel and may have done horrible things. But it is beyond clear that Fennell committed the murder. It is sad that some sick angry people would like to see him killed to avenge their anger towards him.

    3. Her nails were not clipped. The truck was seized by DPS on April 23 for processing and released on April 29. Fennell's father picked it up and drove it to the dealership where it had been purchased, Bob Gold's Chevrolet, Giddings, to trade in for a different vehicle. Stacy & Fennell lived in Giddings, so not an "out of town dealership." This is all evidence from the trial.

      Additional dna testing results came back to Reed. His semen was found in her and on her. His saliva on her breast. His dna was also found on her pants, her back brace, the truck, her panties. He's guilty. What is sick is the length and lies people like you will go to set a serial rapist and a murderer free.

    4. Yes his dnamay have been on her body as they were in a consensual relationship, DNC was not found in the truck. DNA on the belt which was used to strangle her was never tested which is one of the reasons a new trial is being sought.

    This Case is Very Sad.... With all the Evidence Thats Been Brought Foward and Yet Rodney Is Still Locked Up and Whats Even Sadder...They are Refusing Him A New Trial Because They Know He Will Be Proven Innocent and Will Put A Nasty Of Shame In The Mouthes That Wrongfully Convicted Him.If They Have No Fear Of Rodney Now Being Freed Whats The Reason Of Keeping Him From A New Trial...I Know The Reason it's Because He Black and the Actual Perpetrator is White and God Forbid That Side of The Truth Be Told. Yes Rodney is A Black Man Who Was Involved With A White Woman....Those Are The Facts. So From Fennell Down to the other cops who Helped His Cover Up. on Down To Those in Charge of Denying A New Trial..THEY SHOULD ALL BE HELD ACCOUNTABLE FOR THIS INNOCENT MAN BEING LOCKED ALL THESE YEARS FOR A CRIME HE DID NOT COMMIT.....FREE RODNEY AND GIVE DEATH TO THE ACTUAL KILLER AND LOCK THOSE UP WHO HELPED HIM
